How to become a military lawyer in South Africa
There is no route into South African military law that skips the civilian profession. You qualify and are admitted as an ordinary legal practitioner, then you are appointed as an officer. The military part comes last.
Who regulates this
The Legal Practice Council, under the Legal Practice Act 28 of 2014, with admission granted by the High Court of South Africa. Your employer would be the Defence Legal Services Division of the SANDF, whose senior posts are created by the Military Discipline Supplementary Measures Act 16 of 1999.
The route
An LLB from a university registered in the Republic. Practical vocational training as a candidate legal practitioner. The LPC's competency-based assessment. Admission by the High Court and enrolment as an attorney or advocate. Only then, appointment to Defence Legal Services. Section 24 of the Legal Practice Act requires South African citizenship or permanent residence.
What catches people out
The jobs people actually mean by "military lawyer" have statutory floors written into them. A military judge must be "an officer of not less than field rank and with not less than three years experience as a practising advocate or attorney of the High Court of South Africa." The Director of Military Prosecutions must be "of a rank not below that of colonel or its equivalent, with not less than five years appropriate experience." These are not preferences in a job advert; they are in the Act, and no amount of legal talent shortens them.
Military lawyer salary in South Africa
There is no published salary scale for SANDF legal officers, and that is a deliberate feature of how South African defence pay works rather than a gap in the public record. It is worth understanding, because almost every figure you will find online for this role is invented.
Why no table exists. Most South African public-service pay is published. The DPSA issues salary determinations covering salary levels 1 to 12 and the Occupation Specific Dispensations, including Appendix C, the OSD for Legal employees — which is where you would expect a state lawyer's pay to sit. But DPSA Circular 15 of 2026, the current determination effective 1 April 2026, states at paragraph 7 that it does not apply to personnel employed under the South African Defence Act, 2002. A uniformed legal officer in Defence Legal Services is appointed under that Act, so they fall outside the published tables entirely.
The distinction that catches people. Civilian legal staff employed inside the Department of Defence under the Public Service Act are on the DPSA scales and the Legal OSD. Uniformed legal officers are not. Two lawyers in the same building can be paid under completely different regimes.
How the pay is actually set. Under the Defence Act 42 of 2002 the Minister of Defence and Military Veterans, in consultation with the Minister of Finance, determines conditions of service for Defence Force members. Pay runs on rank-linked salary scales with notch progression: members move from the first notch of the scale attached to their rank through to the last notch of that scale, then move scale when they are promoted.
What that means for your earnings. Your rank sets your band, not your years of legal experience — which is the single most important thing to understand about this career path. The statutory posts make the point: a military judge must hold at least field rank with three years' practice behind them, and the Director of Military Prosecutions must be a colonel or equivalent with five years' experience. Advancement in military law is advancement in rank.
Treat any rank-by-rank SANDF salary table you find online as unsourced. The Department of Defence publishes aggregate compensation-of-employees expenditure in its annual report and budget vote, not per-rank bands.
